General terms and conditions De Leeuwerik
When you book a holiday, it is nice to know in advance what you are entitled to. Read below about payment options, rules on cancelling and rebooking and the rules for when you bring your dog along.
Application

These General Terms and Conditions apply to reservations of holiday homes that are rented out by De Leeuwerik, hereinafter referred to as De Leeuwerik/we. These General Terms and Conditions apply to bookings made on or after the validity date referred to above.

When making a booking you must have taken note of the general terms and conditions and agree to these. The Terms and Conditions will apply from that time.

In these General Terms and Conditions the concept ’tenant’ and ‘you’ is taken to mean: the person who concludes an agreement with De Leeuwerik with regard to renting/using our holiday homes. The concept ’user’ (also referred to below as ‘guest’) is taken to mean: the tenant and the persons stated by the tenant who (will) use the holiday home rented by the tenant and/or other facilities.

Arrangements derogating from these General Terms and Conditions will only be valid if these have been agreed in writing.

The law of the Netherlands exclusively applies to the agreement between you and De Leeuwerik.
Booking

An application for reservation of a holiday home of De Leeuwerik can be made on the internet, by email or by telephone. Receipt will be confirmed by mean of a request for a (down) payment.

Booking a holiday home of De Leeuwerik can only be done from the age of 21 years.

Our holiday homes are not rented for (stag) parties and/or similar events.

We retain the right at all times - without stating reasons - to refuse a reservation.

After booking you will receive a confirmation from us, which also serves as an invoice. Personally check straight away whether the details are correct. We would like to hear immediately if there are any inaccuracies. There will be a booking at the time that De Leeuwerik has confirmed the reservation to you.

We do not charge booking or service charges.
Payment
-
The following payment terms apply:

Within 24 hours after booking
30% of the rent. -
6 weeks (42 days) before arrival
70% of the rent. -
For a booking with arrival within six weeks (42 days)
Within 24 hours after booking: 100% of the rent.

In the event that payment of the rent is not made in time, you will receive an email message from us regarding this. We will set out a new payment term in this. If there is again no payment made in time, the tenancy agreement will be cancelled and De Leeuwerik will have the right to charge the cancellation charges.
Cancellation
What happens in the unlikely event that your holiday does not go ahead? In that case comply with the following cancellation conditions, applicable to bookings at www.deleeuweriktexel.nl:

Within 24 hours after booking
Free of charge, you will be refunded 100% of the booking (down) payment amount already paid. For a booking with arrival within six weeks (42 days), the option to cancel free of charge will no longer apply. -
Up to six weeks (42 days) before arrival
Free of charge, you will be refunded 100% of the booking (down) payment amount already paid. -
Up to 7 days before arrival
50% of the booking amount will be refunded to you. -
Within 7 days before arrival
10% of the booking amount will be refunded to you. -
On the arrival date or during the stay
0% of the booking amount will be refunded to you.

The right of withdrawal does not apply to our services.

De Leeuwerik has the right to withdraw your booking up to 48 hours after the time of the booking, stating reasons.
Changes
-
Up to 30 days before arrival changing the date or holiday home will be possible, depending on availability.

Booking extras is possible at all times depending on availability. Early check-ins and/or lazy check-outs are the exception from this, these can be booked no later than 24 hours before checking in or out.

If there is a difference in the rent, the difference will be at the expense of the guest. This difference must be paid before the payment term stated by De Leeuwerik.

If, after the coming into effect of the agreement, you wish to make changes in the agreement, De Leeuwerik will not be obliged to accept these.

If, due to other circumstances, De Leeuwerik must make a change in a reservation you have booked concerning the location, period of stay or type and/or location of the holiday home, De Leeuwerik can offer you a suitable alternative.

The tenant and other users are not permitted to give the use of the holiday home however described or for whatever reason to anyone other than the persons referred to in the agreement, unless agreed otherwise in writing with De Leeuwerik.

If you wish to terminate your stay prematurely, or transfer it to another user, you will remain jointly and severally liable to De Leeuwerik for the stay of the new user as well as for the payment of the outstanding part of the rent, any extra costs resulting from the transfer and any cancellation charges.
Checking in and out

The rented holiday home will be available from 16:00 hours on the agreed arrival date.

Leaving luggage and/or parking cars or bicycles before the time of check-in and/or after the time of check-out is not allowed.

The check-in and out will take place by means of the transfer of the key.

When checking in a personal parking space will be allocated, which will be valid during the entire stay and will be suitable for one car. It is not permitted to mutually exchange or change parking spaces.

On the agreed departure date the holiday home must be left tidy and the key must be returned to the manager before 10:00 hours.

If the use of the holiday home and/or other facilities is terminated earlier than on the agreed date as set out in the booking confirmation, the tenant will not have any right to a refund of (part of) the rent and/or costs by De Leeuwerik.

We make the key of the holiday home available on loan for use to the tenant. The key remains the property of De Leeuwerik. In the event of loss, damage, theft or loss of the key in any other manner, the tenant will be obliged to compensate the damage.
Stay
- All guests must comply with the rules recorded by De Leeuwerik for the park and our holiday homes, which are recorded in the company rules. These rules can be found in the information folder in the holiday home.
- In the event of breach of the rules included in these General Terms and Conditions, the company rules and/or failure to follow instructions from the staff, De Leeuwerik will have the right to remove you, the tenant and any other user from the park, without any refund of the rent or any part thereof.
- It is not allowed to stay overnight with more persons than stated in the reservation and in the confirmation. Would you like to receive guests? Then state this in advance to the manager and pay the mandatory tourist tax for this. A maximum number of 4 persons, including babies and children, applies for our holiday homes. In the event of exceeding of the number referred to, De Leeuwerik will have the right to terminate the agreement, the cancellation conditions apply to this.
- Our holiday homes and the grounds are smoke-free. Smoking and barbecuing are not permitted. It is also not allowed to use or possess drugs or narcotics in our park.
- The two private parking spaces in the car park are for the manager(s) and have an electric charging point. The charging point is only accessible, provided that this is available, for the guests of De Leeuwerik. When a car has been fully charged, the guest must park this again in the allocated parking space. It is not permitted to use these parking spaces other than for charging an electric car.
- De Leeuwerik retains the right to make changes to the set-up and access to the park facilities without entitling you to compensation.
- Moving the inventory or taking any part of the (indoor) inventory outside is expressly not allowed, with the exception of the crockery/glasses and cutlery for your meal outside. The use of equipment, inventory and facilities other than for their intended purpose is also not permitted.
- You are not entitled to compensation for necessary or commonplace maintenance of the holiday home or the facilities.
- The tenant must leave the holiday home in a tidy condition (i.e. no dirty dishes, tidy floor, take off the bed linen, clean the kitchen and refrigerator, put rubbish bags in the container).
- If the park manager seriously suspects that the tenant of the holiday home is acting contrary to the law and/or public order and/or accepted moral principles, the manager will be entitled to gain access to the holiday home.
Pets

One dog is permitted in the following homes: De Veldleeuwerik, Windlust, Het Zandblauwtje and De Strandvondst. The other homes are pet-free and it is not permitted to allow a pet to go in there.

In the homes where a dog is permitted, pets other than a dog are not permitted. De Leeuwerik retains the right to refuse (without stating reasons) pets in the park.

If you and/or another user wishes to bring a dog, you must state this immediately when making the reservation. In that case De Leeuwerik will charge a surcharge to you, which you will have to pay. Visitors' pets are not permitted.

Outside the holiday home with a garden the dog must be on a lead. The instructions on-site must be followed. The dog must not be a nuisance to the other guests and neighbours.
Prices

The agreed rent, as set out in the booking confirmation will apply to you.

Price discounts and/or special offers can no longer be used if the confirmation of the reservation/invoice has been sent by De Leeuwerik.

All prices, insofar as applicable, are including VAT, unless stated otherwise.

De Leeuwerik is entitled to implement and settle price increases resulting from interim adjustments of statutory regulations or provisions (including, but not limited to, VAT, tourist tax and insurance premium tax), which are beyond the control of De Leeuwerik. The amount of the tourist tax will be recorded by the municipality of Texel. You/the tenant will at all times owe De Leeuwerik the applicable tourist tax rate recorded by the relevant municipality.
Force majeure and changes

In the event that De Leeuwerik is unable, whether or not temporarily, to implement the agreement, wholly or partly, due to force majeure, we will have a change proposal submitted (for another holiday home/another period, etc.) within 14 days after we have become aware of the impossibility of performing the agreement. The suspension of the fulfilment of the obligations by De Leeuwerik will be permitted if circumstances occur, which are beyond the control of De Leeuwerik. Under no circumstances will De Leeuwerik be obliged to pay compensation of any damage or costs.

There will be force majeure on the part of De Leeuwerik if De Leeuwerik is prevented from performing the agreement wholly or partly, whether or not temporarily, due to circumstances beyond the control of De Leeuwerik, including threat of war, strike actions, blockades, fire, epidemics, floods and other disruptions or events.

De Leeuwerik is entitled at all times to terminate the agreement with immediate effect if, when making the reservation, personal data related to you and/or other users are incomplete and/or incorrect. In such a case no refund of the rent or a part thereof will take place.
Liability - damage - complaints

The tenant and other users are, during the rent period in the rented holiday home concerned, fully liable for all damage caused to the home, the inventory and all items forming part of the rented accommodation, unless the tenant and other users can make it plausible that the damage cannot be attributed to them. Immediately report to us when you notice damage or defects. The costs in the event of damage will be charged by De Leeuwerik to the tenant.

Under no circumstances will De Leeuwerik be liable for theft, loss or injury/damage of or to property or persons, of whatsoever nature, during or as a result of the stay in the holiday home or on the grounds.

In the event of improper use, improper departure, including failure to leave the holiday home clean, extra costs will be charged. After De Leeuwerik has established the extra costs, you/the tenant will be obliged to pay these costs in conformity with the payment term set out by De Leeuwerik.

De Leeuwerik will not be liable for building work at the access roads and main roads and suchlike in the surrounding areas of the rented holiday home. De Leeuwerik will not be liable in the event of the failure or (partial) rendering inoperative of technical equipment, mains services and/or the (partial) non-functioning of the internet.

The costs of the usual maintenance and repair of defects are at our expense. If defects occur, you must immediately report this to us and follow our instructions as much as possible.

Privacy

All the data that you provide to us will be included in a file. The data file will be used for our guest records. De Leeuwerik will use this data to send focused information and offers regarding your stay and our services.

At your request, we will correct, supplement, delete or block your data, for example in the event that it is factually incorrect.
